I wish to thank you for inviting me to attend the National Prayer Breakfast that will be held this week in WashingtonDC with President Obama’s participation.

Unfortunately, I am unable to accept your gracious invitation as the U.S. Embassy here in Kiev has continued to delay issuance of a visa to the point where there is now insufficient time for me to make travel arrangements that would allow me to attend this important event. This is the case even though my visa request was submitted pursuant to established procedures and well within accepted time limits for processing such requests.

I cannot but conclude that such behavior by the U.S. State Department demonstrates a distinct disrespect towards Ukraine in general and towards me as one of her citizens. Such conduct, in my view, also reflects disrespect towards the U.S. Congress, which extended to me the honor of participating in this world spiritual event.

In light of the foregoing, I deeply regret that I will not be able to accept your invitation to the National Prayer Breakfast. As we all are aware, the NPB in US is a spiritual holiday seeking to promote common goals of goodwill and cooperation among the many states and religions that will be represented there. It is most certainly not intended as a political event, but as a humanitarian and spiritual one.

Regrettably, this fact has been ignored in the decision by the U.S. Department of State to deny me the opportunity to participate in this most wholesome of celebratory events.

I wish you and all the participants in this week’s proceedings much success and trust that I and my colleagues from Ukraine will be welcomed to take part in future such endeavors that emphasize what is positive in our relationships

На жаль, я не маю змоги прийняти ваше люб'язне запрошення, оскільки Посольство США тут, у Києві, продовжує затримувати видачу візи настільки, що зараз у мене недостатньо часу, щоб організувати поїздку, що дозволило б мені відвідати цю важливу подію. Ситуація саме така, навіть попри те, що мій запит про видачу візи був поданий відповідно до встановлених процедур та в межах встановлених строків для опрацювання таких запитів.

Я можу лише дійти висновку, що така поведінка Державного департаменту США демонструє явну неповагу до України в цілому та до мене як до одного з її громадян. Така поведінка, на мою думку, також відображає неповагу до Конгресу США, який удостоїв мене честі взяти участь у цій світовій духовній події.

У світлі вищезгаданого, я дуже шкодую, що не матиму можливості прийняти ваше запрошення на Національний молитовний сніданок. Як нам усім відомо, НМС у США є духовним святом, мета якого полягає у просуванні спільних цілей доброзичливості та співробітництва між багатьма державами та релігіями, які будуть там представлені. Поза всяких сумнівів, його призначення не політична подія, а гуманітарно-духовна.

Прикро, що цей факт був проігнорований у рішенні Державного департаменту США позбавити мене можливості взяти участь у найбільш корисному зі святкових заходів.

Dear Mr. President:

Please accept my congratulations on your victory. I wish you and your family health, happiness and prosperity.

The United States of America undoubtedly hold leadership as the standard-bearer of human rights and the stronghold of democracy. We highly appreciate the efforts of the USA that are directed to developing bilateral dialogue between our countries. We also value your aid in the formation of Ukraine as a constitutional state. We are certain that the United States is a strategic partner for Ukraine in the fight against organized crime and corruption.

By way of this letter, I would like to direct your attention to one of the burning issues that has complicated relations between Ukraine and the USA. This issue concerns the continuous interference of American lobby group in the taking of depositions of witnesses in the murder case of Eugene Scherban, the slain Ukrainian Member of Parliament. The matter is about Pavel Lazarenko, Peter Kirichenko and Nikolai Melnichenko, who now live in the USA and publicly claim their consent to give evidence in the case. The Prosecutor General's Office of Ukraine has requested about 30 times that the U.S. Department of Justice assist us in organizing the interrogations of the aforementioned witnesses. Nonetheless, the U.S. Department of Justice continues to ignore these requests for depositions from Ukrainian.

By way of background, I should remind you that the Member of Ukrainian Parliament, Eugene Scherban, together with his wife and two colleagues, were shot in Donetsk airport in November 1996. After the shootings, only Mr. Scherban's son survived. The actual perpetrators of the crime were found and they sustained punishment. The Prosecutor's Office is vigorously pursuing those who ordered this murder.

The witnesses in this case, that reside in Ukraine, have given evidence to the Ukrainian Prosecutor General's Office, that in 2005 they, in accordance with the U.S. established procedure, provided documents upon the matter of Eugene Scherban's murder and other related crimes to the U.S. Department of Justice. The Ukrainian Prosecutor General's Office requested copies of this documentary evidence from the U.S. Department of Justice, as well as from the U.S. Ambassador Extraordinary and Plenipotentiary to Ukraine, John Tefft. Ukrainian Prosecutor General's Office received no response to these requests for copies of this documentation from the U.S. Department of Justice. We had to resort to direct public appeals to American authorities with the request to receive assistance in investigating relevant cases. In response, American Ambassador to Ukraine, John Tefft, claimed, that he had no information concerning availability of the aforementioned documentation requested by Ukrainian Prosecutor General's Office. The U.S. Department of Justice has remained silent. Consequently, there is an impression, forming in Ukraine, that some American officials are concealing information, which could aid in the search for those, who ordered Eugene Scherban's murder.

In addition, there is another very hazardous situation that has caused me to address this letter to you, dear Mr. President. There is an elaborated plan by the U.S. Department of Justice, initiated by some American and Ukrainian politicians, to counteract and eliminate the case of Eugene Scherban's murder. One of the objectives of this plan is contravene the Ukrainian Prosecutor General's Office indictment of Julia Tymoshenko and Pavel Lazarenko within the confines of the case. A former employee of President Leonid Kuchma's security staff, Nikolai Melnichenko, who has recently returned to Ukraine from the USA, gave evidence about this plan to Ukrainian Prosecutor General's Office investigators. One of the goals of this plan is not only to discredit the Ukrainian Prosecutor General's Office investigative group, but to discredit me personally as well. Initiators of the plan presumed to provoke my arrest in the territory of the USA, based upon specially fabricated indictments. Nikolai Melnichenko was to become a participant in this international provocation. The goal of my arrest was the discredit of my person before American authorities and thus corroborate that my actions' were illegal in the USA. I was to be incriminated by alleging that I coerced a witness, Nikolai Melnichenko, in a murder case to give evidence to Ukrainian Prosecutor General's Office investigators. Thus, the initiators of the plan intended to force termination not only of this murder investigation by Ukrainian authorities, but also other crimes, of which Mrs. Tymoshenko is accused.

During the interrogation process in Ukraine, Nikolai Melnichenko named all of the Ukrainian and American citizens involved in this unlawful plan. According to him, they were the representatives of lobbying firm Wiley Rein, LLP, Joe Williamson and Ralph Caccia, who were hired by Tymoshenko's husband, Alexander, for creating her positive image in the USA and to discredit Ukrainian investigators. Also among those mentioned was former U.S. Congressman Jim Slattery, who lobbied Tymoshenko's interests in the U.S. Congress and before the State Department, using personal relationships with the head of the U.S. State Department, Mrs. Hillary Clinton. There was also the lawyer Steve Bunnell, who assisted present Assistant Attorney General of the USA.

Nikolai Melnichenko warned me beforehand about the provocation being prepared, was the only reason my illegal arrest in the USA was prevented.

I would like to emphasize, dear Mr. President, that the aforementioned persons, using their contacts, lobbied for the adoption of Resolution № 466 by the U.S. Senate in 2012, with the aim of intimidating Ukrainian authorities and forcing Ukrainian Prosecutor General's Office to terminate its investigation of the murder case, in which Julia Tymoshenko is involved.

At the end of September of this year, I addressed to the U.S. Congress as well as to the Vice President of the USA, Joseph Biden, an open letter. Prosecutor General of Ukraine, Viktor Pshonka, conveyed this letter to the U.S. Ambassador to Ukraine, John Tefft. In the open letter I expounded my position and offered to organize my speech upon the case of Eugene Scherban's murder in front of the U.S. Congress and American media representatives. I received no response to this letter, but on October 19, 2012, Mr. Tefft informed me about the cancellation of my 5 - year multiple entry visitor's visa to the USA without providing any further explanations.

From my point of view, these actions contravene the international cooperation regulations between our two countries and undermine the authority of the United States. The officials from the State Department and the Department of Justice of the USA do not recognize international legal regulations and, in fact, show the example of the office abuse. They delude the President of the USA, Congress and American nation concerning Eugene Scherban's murder and Julia Tymoshenko's actual role in different crimes.

Ukraine cherishes great hopes for establishing the truth in this case of Eugene Scherban's murder and instituting criminal proceedings against those who ordered this serious crime.

Dear Mr. President, I ask for your assistance in establishing the truth. I ask for your assistance in helping us obtain the sworn testimony of Peter Kirichenko and Pavel Lazarenko, residing in the USA, the witnesses in the case of Eugene Scherban's murder. I ask for your unbiased appraisal of American officials' actions, involved in organizing provocation against my person. I ask you to use the powers of your office to encourage the U.S. Senate to reconsider its recently adopted Resolution № 466 in order to make an informed decision concerning Ukraine that is based upon facts.

I would like to express my gratitude to you for your attention, as well as hope for continuing both working and human relations between our countries.

США, поза сумнівом, є лідером у захисті прав і свобод людини та оплотом демократії. Ми високо цінуємо зусилля США, спрямовані на розвиток двостороннього діалогу між нашими державами. Ми також цінуємо Вашу підтримку з розбудови в Україні правової держави. Ми впевнені, що США є стратегічним партнером України у боротьбі з організованою злочинністю і корупцією.

У цьому листі я хочу привернути Вашу увагу до гострої проблеми, яка ускладнює відносини між Україною та США. Суть проблеми полягає в тому, що група американських лобістів тривалий час перешкоджає проведенню допитів свідків у справі про вбивство члена українського Парламенту Євгена Щербаня. Мова йде про Павла Лазаренка, Петра Кириченка і Миколу Мельниченка, які на даний час проживають у США і публічно заявили про свою згоду дати свідчення у справі. Генеральна прокуратура України близько тридцяти разів зверталася до Департаменту юстиції США з проханням посприяти в організації допитів згаданих свідків. Незважаючи на це, до сьогодні Департамент юстиції США ігнорує звернення української сторони про проведення допитів.

Хочу Вам нагадати, що депутат українського Парламенту Євген Щербань з дружиною і двома колегами були розстріляні в аеропорту міста Донецька в листопаді 1996 року. Тільки син Євгена Щербаня залишився живим після обстрілу. Виконавці цього вбивства були знайдені і понесли покарання. Прокуратура близько підійшла до замовників цього вбивства.

Свідки у цій справі, що проживають в Україні, дали свідчення Генеральній прокуратурі України про те, що в 2005 році вони відповідно до встановленої в США процедури надали американській владі документи про вбивство Євгена Щербаня та інші пов'язані з ним злочини. Генеральна прокуратура України звернулася за допомогою в отриманні цих документів до Департаменту юстиції США, а також до Надзвичайного і Повноважного Посла США в Україні Джона Теффта. Генеральна прокуратура України не отримала відповіді від Департаменту юстиції США на наші звернення щодо надання копій цих документів. Ми були змушені вдатися до публічного звернення до американської влади з проханням сприяти розслідуванню резонансних справ. У відповідь Посол США в Україні Джон Теффт заявив, що не володіє інформацією про наявність в американської влади згаданих документів, запитуваних Генеральною прокуратурою України. Департамент юстиції США досі не відповідає на наші звернення. Внаслідок цього в Україні формується враження, що деякі американські чиновники приховують інформацію, яка б допомогла встановити замовників убивства Євгена Щербаня.

Звернутися до Вас, шановний пане Президенте, мене змусила ще одна дуже небезпечна ситуація. Департаментом юстиції США за ініціативи деяких американських і українських політиків розроблено ретельний план з протидії та знищення справи про вбивство Євгена Щербаня. Одним із завдань цього плану є перешкоджання Генеральній прокуратурі України у висуненні обвинувачення Юлії Тимошенко і Павлу Лазаренко в рамках цієї справи. Про цей план слідчим Генеральної прокуратури України повідомив колишній співробітник охорони Президента Леоніда Кучми Микола Мельниченко, який нещодавно повернувся в Україну із США. Одним із елементів цього плану є дискредитація не лише слідчої групи Генеральної прокуратури України, а й мене як її керівника. Ініціатори плану припускали спровокувати мій арешт на території США за спеціально сфабрикованими звинуваченнями. Микола Мельниченко мав стати учасником цієї міжнародної провокації. Метою мого арешту мала стати моя дискредитація в очах американської влади і, як результат, підтвердження незаконності моїх дій в США. Мені мали інкримінувати, що на території США я начебто примушував свідка Миколу Мельниченка до давання свідчень у справі про вбивство слідчим Генеральної прокуратури України. Отже, ініціатори плану мали намір змусити українську владу припинити розслідування не лише справи про вбивство Євгена Щербаня, але й інших злочинів, у яких обвинувачується Юлія Тимошенко.

Під час допиту в Україні Микола Мельниченко назвав імена і прізвища всіх громадян України і США, причетних до цього незаконного плану. З його слів, це були представники лобістської фірми «Вілей Рейн» Джо Вільямсон і Ральф Чача, яких найняв чоловік Тимошенко, Олександр, для створення її позитивного іміджу в США і дискредитації українських слідчих. Також серед згаданих осіб був колишній сенатор Джим Слеттері, який лобіює інтереси Тимошенко в Конгресі і Державному департаменті США, використовуючи особисті стосунки з керівником Державного департаменту, - пані Хілларі Клінтон. Це був й адвокат Стівен Буннел, який працював помічником діючого заступника Генерального прокурора США.

Микола Мельниченко заздалегідь попередив мене про підготовлювану провокацію, що допомогло мені уникнути незаконного арешту в США.

Звертаю Вашу увагу, шановний пане Президенте, що згадані вище особи, використовуючи свої зв'язки, лобіювали прийняття Сенатом США резолюції № 466 у 2012 році, яка мала залякати українську владу і змусити Генеральну прокуратуру України припинити розслідування справи про вбивство, до якого причетна Юлія Тимошенко.

Наприкінці вересня цього року я звернувся з відкритим листом до Конгресу, а також до Віце-президента США Джозефа Байдена. Генеральний прокурор України Віктор Пшонка передав листа Послу США в Україні Джону Теффту. У відкритому листі я виклав свою позицію і запропонував організувати мій виступ перед конгресменами і представниками американських засобів масової інформації з доповіддю у справі про вбивство депутата Євгена Щербаня. Відповіді на листа я не отримав, але 19 жовтня 2012 року пан Теффт повідомив мені про анулювання моєї багаторазової п'ятирічної візи у США без пояснення причин.

На мою думку, ці дії порушують норми міжнародного співробітництва між нашими державами і підривають авторитет США. Чиновники з Департаменту юстиції і Державного департаменту США, незважаючи на міжнародно-правові норми, фактично незаконно використовують своє посадове становище. Вони вводять в оману Президента США, Конгрес і американський народ щодо вбивства Євгена Щербаня і фактичної ролі Юлії Тимошенко у різноманітних злочинах.

Україна покладає великі надії на встановлення істини у справі про вбивство Євгена Щербаня і притягнення до кримінальної відповідальності замовників цього тяжкого злочину.

Шановний пане Президенте, я прошу Вашої допомоги у встановленні істини. Прошу Вашого сприяння в отриманні свідчень від свідків у справі про вбивство Євгена Щербаня, Павла Лазаренка і Петра Кириченка, які перебувають у США. Прошу Вас дати об'єктивну оцінку діям американських чиновників, причетних до організації провокацій стосовно мене. Прошу Вас, використовуючи можливості Вашого відомства, запропонувати Сенату США переглянути нещодавню резолюцію № 466 для прийняття зваженого рішення щодо України, яке б ґрунтувалось на реальних фактах.

Я вдячний Вам за увагу і ще раз висловлюю сподівання на продовження ділового і людяного співробітництва між нашими державами.

STATEMENT

I ask the Attorney General of Ukraine to institute criminal proceedings under Articles 121, 170, 171 CC of Ukraine on the fact of my being beaten.

March 24, 2012 at the time of gathering information for writing (for newspaper "BULLETIN YOUTH") and the preparation of material for recording TV program "Youth view" (project of Kyiv city organization of Ukrainian Youth Association), I received a severe injury (see Appendix № 1 - Extract from inpatient medical records of the Kiev City Clinical Emergency Hospital) in a micro-region of Kiev Teremki-1. I was admitted to the hospital (where was treated for two and a half months), and underwent several operations. As a result of my disabled state I could not complete: the collection of information for newspaper "BULLETIN YOUTH and Projects association of citizens, which I run as the head of the Kyiv city organization of Ukrainian Youth Association (project: "The television program "Youth View ", "The competition of social advertising ", “The new space of the Commonwealth of Independent States", "Musical Show "Kiev Youth against drugs", "International Youth Cultural Exchange", "Charity Concert "Justin Bieber for a healthy lifestyle".). Experienced doctors who participated in my treatment, told me that such a severe injury from a fall is impossible. They talked, they said - "They tried to beat you to the death, you miraculously survived." My head was beaten from all sides and looked like a soccer ball, and other body parts are not damaged. In the statement of my medical records the doctors wrote: "The trauma was obtained during a beating by unknown." And "Alcohol in the blood - not found."!

Day and the circumstances when I was seriously injured I remember very bad. I remember that before I got seriously injured, I likely (not sure) communicated with a large (about a dozen people critical against my party), a group of young people (the company) of which seem to have been: (...)

I remember that in the hospital (at the beginning of my treatment) police came to me (RU Darnytskyi Ministry of Internal Affairs of Ukraine, Kyiv), but then I was in a bad state (after a serious injury, coma, and the operation of trepan the skull), so do not I remember what the testimony and explanations I gave, and that I signed. In this regard, please be considered null and void all my readings and explanations provided by me in time of my hospitalization (from 03/25/2012 to 06/11/2012). Now I'm going to draw a disability.

Due to the fact that severe injuries received by me near the place of mass permanent residence of workers of the Security Service of Ukraine, RU Holoseievski Ministry of Internal Affairs of Ukraine in Kiev, the Prosecutor's Office Holosiivskyi district of Kiev, Kiev City Prosecutor's Office, the Interior Ministry of Ukraine, State Security Service Ukrainian Interior Ministry and the Foreign Intelligence Service of Ukraine, I beg to result exclusively by the Prosecutor General of Ukraine. Also, in connection with the above indicated, I ask the Attorney General of Ukraine to provide me with legal and physical protection (security).

At the time of the investigation give my permission to the Prosecutor General of Ukraine and agree to the removal of information from the channels of communication that I use.

In connection with the above, please take the Prosecutor General of Ukraine in the production of the General Prosecutor's Office instituted criminal proceedings Desnyanskiy RU Ministry of Internal Affairs of Ukraine in Kiev on the theft of my Pocket PC Toshiba G 900 and a memory card (there were files of the newspaper "BULLETIN YOUTH" and Kyiv city organization of Ukrainian Youth Association, as well as access codes to the blog on site of the Democratic Party of the United States and Barack Obama), which were stolen from me in the hospital in time of my hospitalization.

Dear friends!

I've received an invitation to a reception in honor of Barack Obama and the First Lady from Sarah Jessica Parker. I was delighted and decided to go to this event with a colleague to welcome the U.S. President Obama and the First lady. I postponed my rehabilitation vacation on the sea (I am after a long illness - two months ago i came out of a coma). I was automatically registrated for the reception. Unions are vital to protect workers. That's especially true in this era where the rich own a greater share of the wealth than at any time since the Great Depression (as Robert Reich pointed out). Also, unemployment and underemployment are high, the stock market has recovered, and corporations have lots of cash but aren't doing much hiring.

Still, we can reform unions to keep protecting workers but reduce or eliminate some aspects that cause many average Americans to dislike unions.

The Republicans successfully pit non-union workers against workers. Republicans want to keep tax breaks for millionaires who don't pay their own share, then damage unions to weaken the Democratic party.
